July 16: A New Jersey judge has dismissed Donald Trump's libel lawsuit against an author who Trump had claimed underrepresented his personal wealth, The New York Times reported. 

The author, Timothy L. O'Brien, wrote in a 2005 biography "Trump Nation: The Art of Being the Donald" that Trump's wealth fell between $150 million and $250 million, significantly lower than the $5 billion to $6 billion Trump claims to be worth. A trial court judge had at first ordered O'Brien to name three confidential sources, at Trump's request, but that decision was overturned on appeal because O'Brien was covered by the New York state shield law. The book was published in New York.

February 9: To win a lawsuit, Melania Trump might have to prove how she could profit as first lady

A defamation suit filed by Melania Trump in New York on Feb. 6 is raising yet more questions about whether the Trump family can keep its business apart from the office of the US presidency.

The suit concerns a now-retracted article the Daily Mail published repeating unverified claims that Trump had worked for a modeling agency which also served as an escort service for wealthy clients, and seeks no less than $150 million in punitive damages for emotional distress and the harm caused to Trump’s brand and business opportunities—specifically a “broad-based commercial brand” including, among other things, clothing, shoes, jewelry, and fragrance.

July 19: Earlier this year, a New York Supreme Court judge ruled that some of Donald Trump’s seemingly factual tweets may actually be considered hyperbolic opinion and thus protected free speech for defamation purposes. Earlier this month, Donald Trump tried this alternative facts–style defense in order to try to dismiss another defamation lawsuit. The plaintiff in that case is one of several women who has accused Trump of sexual misconduct. He used Twitter to suggest that the women were liars and she filed the defamation claim in response. Now the president argues that his tweets were mere hyperbole, aka alternative facts.

January 10: Trump Once Again Threatens to Change Federal Libel Laws That Don’t Exist

In the latest in a long line of attacks on freedom of the press, President Trump has once again threatened today to change libel laws to make it easier to sue news organizations, publishers, and others after the publication of an unflattering book.

“We are going to take a strong look at our country’s libel laws so that when somebody says something that is false and defamatory about someone, that person will have meaningful recourse in our courts,” Trump said.

That’s because there’s a law that protects government officials: “There is a federal statute called the Westfall Act that provides broad immunity to federal officials—including elected officials—who make statements, protecting them from defamation liability,” Clare says. “If [Comey] were to bring such a claim, I think he would find himself litigating against the Department of Justice, and against the backdrop of this federal statute. May 17: A New York court said Thursday that former “Apprentice” contestant Summer Zervos can proceed with her defamation lawsuit against President Donald Trump, at least for now.
