July 16: A New Jersey judge has dismissed
Donald Trump's libel lawsuit against an author who Trump had claimed
underrepresented his personal wealth,
The New York Times reported.
The author, Timothy L. O'Brien, wrote in a 2005 biography "Trump Nation: The Art
of Being the Donald" that Trump's wealth fell between $150 million and $250
million, significantly lower than the $5 billion to $6 billion Trump claims to
be worth. A trial court judge had at first ordered O'Brien to name three
confidential sources, at Trump's request,
but that decision was
overturned on appeal because O'Brien was covered by the New York state
shield law. The book was published in New York.

June 22: Trump has claimed it is rare for him to file a defamation
lawsuit, but [editor and reporter Timothy] O’Brien’s lawyers noted the number of
times that he has threatened to sue, citing the following targets:
•
The New York Times
• Rosie O’Donnell
• Fortune magazine
• Author Robert Slater
• George magazine
• Wall Street Journal reporters Neil Barsky and Alex Frangos (for
separate stories)
• The New York Post (twice)
• Tina Brown (after Vanity Fair published a profile that described how
Trump keeps a book of Hitler speeches by his bed, prompting Trump to write Brown
that writer Marie Brennan “was a sick woman who couldn’t see fairness if it was
staring her in the face.”)
• The Chicago Tribune architectural critic Paul Gapp
• The Los Angeles Times‘ David Lazarus

February 9: To win a lawsuit, Melania Trump
might have to prove how she could profit as first lady
A defamation suit filed by Melania Trump in New York on Feb. 6 is raising yet
more questions about whether the Trump family can keep its business apart from
the office of the US presidency.
The suit concerns a
now-retracted article the Daily Mail published repeating unverified claims
that Trump had worked for a modeling agency which also served as an escort
service for wealthy clients, and seeks no less than $150 million in punitive
damages for emotional distress and the harm caused to Trump’s brand and business
opportunities—specifically a “broad-based commercial brand” including, among
other things, clothing, shoes, jewelry, and fragrance.

March 29: Is President Trump Above the Law?
His personal lawyers want a New York court to shield him from private lawsuits
during his presidency.

July 19: Earlier this year, a New York
Supreme Court judge ruled that some of Donald Trump’s seemingly factual tweets
may actually be considered hyperbolic opinion and thus protected free speech for
defamation purposes. Earlier this month, Donald Trump tried this alternative
facts–style defense in order to try to dismiss another defamation
lawsuit. The plaintiff in that case is one of several women who has accused
Trump of sexual misconduct. He used Twitter to suggest that the women were liars
and she filed the defamation claim in response. Now the president argues that
his tweets were mere hyperbole, aka alternative facts.

January 10: Trump Once Again Threatens to
Change Federal Libel Laws That Don’t Exist
In the latest in a
long line of attacks on freedom of the press, President Trump
has once again threatened today to change libel laws to make it easier to
sue news organizations, publishers, and others after the publication of an
unflattering book.
“We are going to take a strong look at our country’s libel laws so that when
somebody says something that is false and defamatory about someone, that person
will have meaningful recourse in our courts,” Trump
said.

March 20: One maxim of constitutional law is
that what’s good for the goose is good for the gander. And in the case of Donald
Trump, it turns out that a legal precedent set by a small, dedicated group of
Republicans who had it out for President Bill Clinton now applies fully to him.
Among them:
George Conway, a lawyer in private practice who, as life’s twists would have
it, happens to be married to Kellyanne Conway.
A judge in New York ruled on Tuesday that
Clinton v. Jones,
a unanimous Supreme Court ruling that established that a sitting president was
not “absolutely immune” from civil lawsuits over actions he took before he was
president, applies with equal force to a case brought by
Summer Zervos, a former Apprentice contestant who is accusing Trump
of defaming her during the presidential campaign. “No one is above the law,”
wrote
Judge Jennifer Schecter in a brisk, 18-page ruling in which she declined to
dismiss the lawsuit.

March 26: Stormy Daniels accuses Trump
attorney of defamation
Stormy Daniels ramped up her legal battle against President Donald Trump on
Monday, alleging in court that his personal attorney Michael Cohen defamed her
by insinuating that she lied about an affair with Trump more than a decade ago.

April 13: Can James Comey Sue Trump For
Defamation? ... The President publicly accused the former FBI director of
committing a crime. So we asked a lawyer
About that part where Trump says Comey lied under oath, i.e. where he accused
him of committing a federal crime? Typically, that’s the kind of thing for which
you could sue. But attorney Thomas Clare—who specializes in
representing clients who’ve been defamed—says it’s not so easy to make a claim
in this case. “The short takeaway is what might be actionable for you or for me,
if we were to be confronted by this in our professional life, is much more
complicated here,” he says.
That’s because there’s a law that protects government officials: “There is a
federal statute called the Westfall Act that provides broad immunity to federal
officials—including elected officials—who make statements, protecting them from
defamation liability,” Clare says. “If [Comey] were to bring such a claim, I
think he would find himself litigating against the Department of Justice, and
against the backdrop of this federal statute. It would be a huge mess.”

May 18: Next Up In Defamation Suit Against
Trump: Discovery, Documents And Depositions
With attorney Michael Avenatti dropping
so
many
bombshells in his zealous representation of his client Stormy Daniels
regarding the
hush agreement that won't shut up, it's easy to forget that President Donald
Trump is also facing a defamation suit by Summer Zervos, a former contestant on
"The Apprentice."
Yesterday a New York state appellate court handed Trump another legal setback
that makes a release of campaign records and depositions from both Trump and
other women who have accused him of sexual misconduct more likely.

May 17: A New York court said Thursday that
former “Apprentice” contestant Summer Zervos can proceed with her defamation
lawsuit against President Donald Trump, at least for now.
The ruling by the Supreme Court’s appellate division means Zervos’ lawyers can
press ahead with a demand for Trump campaign documents and other records while
they await another appeals court decision that is likely months away.

September 15: Donald Trump Warns That
Defamation Lawsuit Could Turn Into 21 Mini-Trials
On Friday night, President Donald Trump submitted a court brief in New York in a
bid to avoid intrusive discovery demands in the ongoing lawsuit brought by
Apprentice season five contestant Summer Zervos, who accuses Trump of
defaming her when denying he attacked her a decade ago in a hotel room. The
president is resisting turning over documents related to alleged illicit sexual
conduct with many other women.
Now, Trump's attorney Marc Kaswowitz is strongly suggesting that if the judge
forces the handover of these documents, Trump will be issuing subpoenas to
nearly two dozen women accusing him of sexual assault. And that, adds Kasowitz,
will become a spectacle.
